Welcome to Happy Belly Food Resources LTD! These Terms of Service ("Terms") govern your use of our services, including our website, applications, and any other products or services provided by Happy Belly Food Resources LTD (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

  • INFORMATION WE COLLECT

    We collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.     • Order and transactional data, such as the information necessary to process your orders when you place an order at one of our restaurants or through the Services for delivery or pick up, information about your payment transactions, and your order history.
    • Communications that we exchange when you communicate with Us, such as when you request support, contact us with questions or feedback, complete our surveys, engage with Us on social media or otherwise interact with Us.
    • Marketing data, such as your preferences for receiving communications about our Services, restaurants, products, activities, events, and publications; details about how you engage with our communications; demographic information such as your gender; and information you provide when you participate in an event, contest or promotion.
    • Other information that is not specifically listed here, which We will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.
    Automatic Collection

    We, our service providers and third party partners may automatically log information about you, your computer or mobile device, and your activity over time on the Site, the App and other online Services, including:

    • Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, the website you visited before browsing to our website, unique identifiers (such as device ID), and general location information such as city, state or geographic area.

    • Precise geolocation data, such as location-based information (by allowing our App to access your location).
    • Security camera footage from within our restaurants.

    Like many online services, We use the following cookies and similar technologies to facilitate some of our automatic data collection:

    We may receive personal information about you from companies that help provide our Services. We may also receive personal information from other third parties, such as:

    • Data providers, such as information services and data licensors.
    • Publicly-available sources, such as social media platforms.
    • Marketing partners, such as companies that have entered into joint marketing relationships or other joint ventures with us.

    Depending on your personal device and App permission settings, when using the App, we may collect or have access to your:

    • Precise geolocation: When you give the App permission to do this, the App may use your mobile device’s location services to collect real-time information about the location of your device (using both GPS and other methods) to provide requested location services, ensure your orders are placed at the correct location, and to serve you relevant offers or promotions.
    • Camera: When enabled, this may allow the App to access the camera to scan and input payment method details. Providing access to your Camera function is entirely optional.
    • Wi-Fi connection information: When enabled, this may allow the App to view Wi-Fi connections.

    Other. The App will send and receive data to and from the Internet, and may view network connections, have full network access, control vibration of your device, or prevent your device from sleeping.

    You may be able to enable or disable geolocation collection by the App by adjusting the permissions in your account or device settings. If GPS precise location services are disabled, other means of establishing or estimating location (e.g., connecting to or proximity to Wi-Fi, Bluetooth, beacons, or our networks) may still be active. Some of the technology described above is used by us or our partners to correlate information collected about you over time across two or more websites or online services. We may combine personal information about you that We receive from third parties with information We have already collected about you and use that combined information pursuant to this Privacy Policy.

    Information Collected from Third Party Platforms

    If you communicate with Us or mention Us via social media (such as Facebook, Twitter, Google, Instagram, Tiktok) or other third party online platforms, We may collect information about you, such as the communications, your name, your user ID and/or user name associated with that platform and any information or content you have permitted the platform to share with Us. The platform provider’s privacy policy will apply to your interactions and its collection, use and sharing of your personal information, including when you interact with pages that We maintain on social media platforms. You or the platforms may provide Us with information about you, and we will treat such information in accordance with this Privacy Policy. You should check your privacy settings in your social media accounts to understand and change the information sent to Us through these services.

    Information About Others

    If you decide to invite a third party to create an account, We will collect your and the third party’s name and e-mail address to send an e-mail and follow up with the third party. As part of your use of the Services, We may provide you the opportunity to connect automatically with your friends through the use of contact importer tools. If you elect to use these tools, We will access information regarding your friends to facilitate automatic connection with your friends. In all cases, when you share the personal information of others with Us, you are responsible for ensuring that you have their permission to do so.

    Children’s Privacy

    The online Services are not intended for and are not intentionally targeted to, children under 13, and we do not knowingly request or collect personal information from any person under 13 years of age through the Services. If we learn that the online Services have received personal information directly from a child who is under the age of 13, we will delete the information in accordance with applicable law.     • Process payment information for online food orders or online purchases through our merchandise or gift card store; process your fundraiser Apps;

    • Advertise to you both on and off the Services, which may include tailoring ads to your inferred interests and measuring the performance of our ad campaigns;
    • Make inferences about connections between different internet-connected devices used by you or members of your household; provide location services;

    • Prevent, investigate, identify, stop, or take any other action with regard to suspected or actual fraudulent or illegal activity, claims or other liabilities, or any activity that violates our policies; or

    Other. The App will send and receive data to and from the Internet, and may view network connections, have full network access, control vibration of your device, or prevent your device from sleeping.

When you click on a link to any other website, mobile App or online service, you will leave our Services and go to another site, and another entity may collect personal information or anonymous data from you. In addition, our content may be included on other online services that are not associated with Us. We have no control over, do not review, and are not responsible for, these third party online services or for their content or actions.     • Text Messages. We may offer communications via SMS texts or similar technology (including via automatic telephone dialing equipment, if we received the appropriate consents from you in accordance with applicable law) sent by Happy Belly or any of its service providers, such as when we send you text messages to confirm, process and notify you about the status and pickup location of an order you place with us, or for any customer service, account-related or marketing purpose. To stop receiving text messages from a code operated by Happy Belly, reply STOP to any message you receive from such code. Note that we may send you a message to confirm receipt of your STOP request. Message and data rates may apply for this service. You can also opt-out of Happy Belly marketing texts by emailing us your request and mobile telephone number to hello@eathappybelly.com
  • CHANGES TO OUR PRIVACY POLICY

    The Company reserves the right to change this policy and our Terms of Service at any time and for any reason.If We make material changes to this Privacy Policy we will notify you by posting the new Privacy Policy at https://eathappybelly.com/privacy_policy.html and changing the effective date listed at the bottom of this Privacy Policy. If required by law We will also provide notification of changes in another way that We believe is reasonably likely to reach you, such as via e-mail or another manner through the Services. Any modifications to this Privacy Policy will be effective upon our posting the modified version as described above (or as otherwise indicated at the time of posting).
